APP Virtual Waiting Room
PRIVACY POLICY
It is a commitment of MYSPHERA, S.L., to inform the users of the application MYSPHERA APP VIRTUAL WAITING ROOM, about its policy regarding the treatment and protection of the personal data of the users collected on the occasion of the use of the service.
By personal data it is understood any numerical, alphabetical, graphic, photographic, acoustic or any other type of information concerning identified or identifiable individuals.
The purpose of the APP Virtual Waiting Room (APP VWR) is the automatic notification of patient status and messages, to send notifications to your mobile phone about status updates and messages of the clinical process being performed by your family member in real time.

WHO IS RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA?
In accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 (hereinafter, RGPD) and other regulations in force regarding the protection of personal data, we inform you that the personal data you may provide during the use of the VWR application (hereinafter, “the application”) will be processed as the person responsible for the processing by MYSPHERA, S.L., (from now on, MYSPHERA, with CIF B98409634 and registered office at Ronda Auguste y Louis Lumiere 23, Nave 13, Paterna (Valencia).
The service is provided by Google’s Firebase Cloud Messaging component, which has the status of a processor, and the relationship is governed by the Firebase Data Processing and Security Terms. The Firebase Terms include Data Processing and Security Terms for all Firebase services in accordance with the RGPD.
MYSPHERA will only be responsible and will guarantee the confidentiality and security of the personal data treated by MYSPHERA for the purposes specified in this document, not having any kind of responsibility regarding the treatment and later use of the personal data that could be carried out by third parties.
WHAT CATEGORIES OF DATA ARE PROCESSED?
MYSPHERA’s Virtual Waiting Room solution does not store any data identifying the user’s mobile phone or any other personal data.
Google Firebase Cloud Messaging is used to send notifications. This service manages which mobiles are subscribed to the MYSPHERA Virtual Waiting Room service, by means of temporary instance IDs. The instance IDs are managed by Firabase and identify the individual installations of an app. Because each instance ID is unique to a given app and device, Firebase services use these IDs to reference specific instances of the apps.
In order to provide the service satisfactorily through the application, access to the camera on your mobile device will be required, with the prior consent of the interested party, since through it you will be able to scan the QR code provided by the hospital and access the service made available to you.
ARE YOU REQUIRED TO FACILITATE YOUR PERSONAL DATA?
If you do not want MYSPHERA to process the personal data in question, please do not use this platform. In any case, MYSPHERA informs you expressly and in a legible way about the conditions in which personal data are collected and the purposes with which they are going to be used, about the obligation to provide them or not, about the rights of the user, about the conditions in which they can be exercised and about any other complementary information that might be necessary.
WHAT DO WE USE YOUR PERSONAL DATA FOR?
The personal data provided by the user for the provision of the service made available through the application will be treated by MYSPHERA according to the following purposes:
– Notification of the patient’s status and messages: To send notifications to your mobile phone about status updates and messages of the clinical process being performed, in real time, from your family member.
WHAT IS THE LEGITIMATION OF THE TREATMENT OF YOUR DATA?
The treatment of your personal data by MYSPHERA is protected by your request of the service made available to you through the application or, in your case, by the consent that is requested for the purposes determined above and that you can withdraw at any time. However, in the event of revoking consent, this circumstance does not affect the legality of the processing carried out previously.
WHAT CATEGORIES OF DATA ARE TREATED?
In any case, the categories involved are
Identification data: Instance ID.
In order to provide the service satisfactorily through the application, access to the camera on your mobile device will be required, with the prior consent of the interested party, since through it you will be able to scan the QR code provided by the hospital and access the service made available to you.
HOW LONG DOES MYSPHERA KEEP PERSONAL DATA?
Firebase stores the instance ID temporarily, deleting it within 180 days of uninstalling the application, as stated in privacy and security in Firebase.
WHAT WILL THE USER DATA BE COMMUNICATED TO?
The personal data provided by the user will not be communicated to third parties, except in the cases provided for in current legislation.
The exercise of the rights by the user is free of charge and can be done at any time. The rights you can exercise are:
• Revoke consent to treatments.
• Access your personal data.
• Rectify inaccurate or incomplete data.
• Request the deletion of your data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
• To obtain from MYSPHERA the limitation of the treatment when some of the conditions anticipated in the regulation of protection of information are fulfilled.
To claim before the Spanish Agency of Protection of Information (www.agpd.es) when you consider that MYSPHERA has violated the rights that are recognized by the applicable regulation as for protection of information.s.
MYSPHERA informs the users that the exercise of these rights is very personal, so only the user himself will be able to exercise these rights with regard to the personal data of which he is the legitimate holder. Nevertheless, and in the cases in which exceptionally it is admitted, the authorized representative of the user will be able to exercise the rights that assist him/her in the exposed terms, whenever he/she accompanies the mentioned communication with the document that proves such representation.
MYSPHERA informs that the exercise of the mentioned rights by a third party not legally authorized by the user, could suppose the commission of the crime of discovery and revelation of secrets foreseen by the second paragraph of article 197 of the Penal Code, punished with imprisonment from one to four years and a fine from twelve to twenty-four months; without prejudice of other consequences to which it would have to face as a consequence of any civil or administrative actions to which both the legitimate user, owner of the personal data, and MYSPHERA, would be entitled.
IS IT SAFE TO PROVIDE PERSONAL INFORMATION?
MYSPHERA will treat the personal data at any moment in an absolutely confidential way and keeping the preceptive duty of secrecy regarding them, in accordance with what is foreseen in the applicable regulation, adopting to the effect the necessary technical and organizational measures that guarantee the security of your data and avoid its alteration, loss, treatment or non authorized access, taking into account the state of the technology, the nature of the stored data and the risks to which they are exposed. However, although we strive to protect your privacy, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure and other factors may compromise the security of user information at any time.nto.
CAN THE PRIVACY POLICY BE CHANGED?
MYSPHERA reserves the right to modify the present Privacy Policy in order to adapt it to the new legislation that could be appropriate. In such cases, and if it is mandatory, the changes will be announced in the application with a reasonable advance to the implementation.
RECOMMENDATIONS TO USERS
MYSPHERA recommends the users to use the latest versions of the computer programs due to the incorporation of higher security measures.
Furthermore, MYSPHERA recommends users to use the security mechanisms available (cryptography, digital signature, firewall, etc.) to protect the confidentiality and integrity of their data as far as it is necessary, given that there are risks of impersonation or communication violation.
